Acceptance
These Terms of Service ("Terms") are an agreement between you and Nova OS Consulting governing your use of Nova AI Desktop Assistant and our website. By downloading, installing or using the Software, or by using the website, you agree to these Terms. If you do not agree, do not use the Software.
Eligibility
You must be able to form a binding contract under the laws of India to use the Software. If you use the Software on behalf of an organisation, you represent that you are authorised to accept these Terms for it.
Accounts
Accounts are optional for initial use. An account is required for subscription activation, license management, renewals and continued premium access. You are responsible for keeping your account credentials secure and for activity under your account.
Subscriptions
Nova is offered as a paid subscription. Your plan, features and price are shown at the time of purchase. We may change plans or pricing for future terms, with notice where required.
Billing
Subscription fees are billed through our payment providers using the payment method you provide. You authorise us to charge applicable fees and taxes for the term you select.
Automatic Renewal
Unless stated otherwise, subscriptions renew automatically at the end of each term at the then-current price, until cancelled. You can cancel before the renewal date to avoid the next charge. Refunds are governed by our Refund Policy.
Acceptable Use
You agree not to misuse the Software, including by using it for unlawful purposes, interfering with its operation or security, attempting to bypass licensing or activation, or using it to harm others. You may not use the Software to violate the rights of third parties.
User Responsibilities
You are responsible for the files, commands and content you provide to the Software and for reviewing the results before relying on them. Nova acts on your instructions; you decide when to grant file access and when to use cloud features.
Intellectual Property
The Software, website and their content are owned by Nova OS Consulting and protected by intellectual-property laws. These Terms do not transfer any ownership to you. Your right to use the Software is described in the EULA.
Third-Party Services
Nova AI Desktop Assistant may use third-party artificial intelligence services and cloud providers to deliver certain features. These providers may change over time. Some Nova features operate locally on your device; cloud-powered AI features require an internet connection. Your use of those features may also be subject to the providers' terms. We are not responsible for third-party services outside our control.
Software Updates
We may provide updates that improve, secure or modify the Software. Updates may be delivered automatically. Some features may change or be discontinued over time.
Termination
You may stop using the Software at any time. We may suspend or terminate access if you breach these Terms, if required by law, or to protect the Software or other users. On termination, your right to use the Software ends.
Disclaimer of Warranties
The Software and website are provided "as is" and "as available", without warranties of any kind to the extent permitted by law. We do not warrant that the Software will be uninterrupted, error-free or fit for a particular purpose.
Limitation of Liability
To the maximum extent permitted by law, Nova OS Consulting will not be liable for indirect, incidental, special or consequential damages, or for loss of data or profits, arising from your use of the Software. Our total liability for any claim is limited to the amount you paid for the subscription in the twelve months before the claim.
Governing Law
These Terms are governed by the laws of India, without regard to conflict-of-laws rules. The courts located in India will have jurisdiction over disputes arising from these Terms.
